Terms of Participation and Privacy Information

These present Terms of Participation stipulate the applicable Conditions of the Katchin Berlin Pop Up Contest and provide information about the raising and using of data submitted by Participants. It is very important that these Conditions are read carefully before entering the Contest. By participation, all Participants agree to be bound by these Conditions and the decisions of the Organizer, which are binding and final in all matters relating to this Contest, and prevail over any other information made in connection with this Contest.

1.    Organizer

The Contest is promoted by Katchin GmbH, Riehenring 182, 4058 Basel, Switzerland (herein after “Organizer”).

2.    Entry Point

The Contest begins on the 7 of June at 08.00 AM CEST and ends on the 15 of June at 11.59 PM GMT (herein after “submission period”). Organizer’s computer is the official time keeping device for this Contest. Participants are responsible for determining the corresponding time zone in their respective jurisdictions.

3.    Eligibility

Entitled to participation are persons domiciled in the United Kingdom, France or Germany who have reached the legal age of majority based on the laws applicable in said country at the time of entry. Employees of Katchin GmbH, and their subsidiaries and affiliated companies as well as the employees’ immediate family (spouses, parents, siblings and children) and household members are not eligible. Proof of eligibility must be provided upon request.

4.    Prize

The price includes any import duties (if any), VAT (if any) and shipping costs, to the address provided by the winner in accordance with article 7 below. The Organizer will not be liable for any prizes which are lost, delayed, or damaged in the post for reasons beyond its reasonable control. Payment of the prize in cash, its asset value, its exchange or its transfer to other persons is not possible.The Organizer reserves the right (when reasonably required to do so) to replace the stated prizes with prizes that the Organizer considers to be of broadly equivalent value.

5.    Participation

The participant will need to fill in the Sweepstakes Entry Form found at:

The Sweepstakes Entry form includes the following information: first name, last name, and email address. This will automatically register participants into the Katchin newsletter database. Participants are not allowed to participate multiple times. No purchase is required to enter or win the Contest.

6.    Winner

Organizer will determine whether the entry on the competition post meets all eligibility criteria and complies with the Conditions of participation. The winner will be determined on 19 of June 2023.

There will be eight winners. The winners will be drawn from all eligible entries.

Organizer reserves the right, in its sole discretion, to reject, disqualify, modify, edit, and revise entries, comments, photos, or related materials that Organizer deems to be obscene, defamatory, profane, offensive, lewd, pornographic, false, misleading, deceptive, or otherwise inconsistent with its editorial standards, audience expectations, or reputational interests or that Organizer believes may violate any applicable law or regulation or the rights of any third party.

7.    Winner Notification

The winner will be notified by email to the email address entered by the Participant as set forth under article 5 above within 7 working days after the end of the Entry Period. If the winner does not answer within 7 days upon such notification, the prize will be forfeited and, at Organizer’s sole discretion, a runner-up winner may be selected. Organizer shall have no liability for winner’s failure to receive notices due to spam, junk e-mail or other security settings or for winner’s provision of incorrect or otherwise non-functioning email address.

The winner is obliged to provide a valid delivery address in the United Kingdom, Germany, or France to the Organizer within 7 days of notification by the Organizer otherwise the prize will be forfeited and, at Organizer’s discretion, a runner-up winner may be selected. Organizer will bear the delivery costs. The winner is responsible for all applicable national, federal, state and local taxes, if any, as well as any other costs and expenses associated with prize acceptance and use not specified herein as being provided.

8.    Data privacy Information

Organizer will process personal data Participants provide in order to conduct the Contest as described in these Conditions.

Organizer will use such data

(i) in order to conduct the Contest (e.g. selecting the winner), ^[1]

(ii) for marketing purposes (e.g. sending Participants' marketing material),

(iii) in the case Participants agree to such use, for the publishing of submissions. The consent may in each case be withdrawn at any time, ^[2]

Participants can object to the processing of their data for marketing purposes at any time by sending an email to: privacy@Katchin.com. For questions related to the data processing the Participants may get in touch with the Organizer’s data protection officer via privacy@Katchin.com. Apart from that Participants may request from Organizer access to the data, its deletion or correction, restriction of the processing and data portability. Participants may also file a complaint with the competent supervisory authority. 9.    Winner Notification

The Organizer points out that the availability and function of the Contest can not be guaranteed. The Contest may be terminated or removed due to external circumstances or constraints without this entitling the Participants to the Organizer. This shall include technical problems, rule changes or decisions by platforms such as Facebook.

10.    Liability

Any compensation obligation of the Organizer and its executive bodies, employees and vicarious agents from or in connection with the competition, for whatever legal reason, is limited to cases of intent or gross negligence, to the extent permitted by law.

11.    Disputes

This Contest is governed by the laws of Switzerland without regard to its conflict of laws rules. Any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action, exclusively before the Courts of Basel-Stadt, Switzerland having jurisdiction. Mandatory applicable consumer protection regulations and laws not amendable by contractual agreement remain reserved. Further, in any such dispute, under no circumstances shall the Participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than Participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Contest). Participant further waives all rights to have damages multiplied or increased.

12.    General Conditions

Organizer reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Organizer’s reasonable control impairs the integrity or proper functioning of the Contest, as determined by Organizer in its sole discretion. Organizer reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or operation of the Contest or to be acting in violation of these conditions or in an unsportsmanlike, offensive or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal or civil law, and, should such an attempt be made, Organizer reserves the right to seek damages from any such person to the fullest extent permitted by law. Organizer’s failure to enforce any term of these conditions shall not constitute a waiver of that provision. Legal action shall be ruled out.

If individual provisions should be or become invalid, this shall not affect the validity of the remaining terms and conditions of participation. These terms and conditions of participation can be changed by the Organizer at any time without any special notification.
